These Terms of Use (“Terms”) govern your access to and use of the MentalJourney mobile application and website (collectively, the “App”) owned and operated by Aaron Charles Gabriel (“I,” “me,” or “my”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the App.

1. Ownership and Intellectual Property

All content on the App—including text, graphics, images, sound, illustrations, and software—is either my exclusive property or used with permission from the respective content owners. The App’s content is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any rights to use any intellectual property owned by me or third parties except as expressly set forth herein.

2. License to Use the App

Subject to your compliance with these Terms, I grant you a non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial purposes. I reserve the right to modify or revoke this license at any time.

2.1. Resource Usage

You agree not to use the App in any manner that excessively consumes system resources or otherwise degrades the performance or availability of the App for other users. I may implement technical measures to prevent or mitigate excessive resource usage.

3. Age Restriction

Due to the sensitive nature of some of the content, the App is intended solely for individuals who are 18 years of age or older. By accessing or using the App, you confirm that you are at least 18 years old.

4. Registration and Account Security

Registration is optional; however, some features require the creation of an account. When you register, you must provide accurate information, verify your email address, and create a secure password. You are solely responsible for maintaining the confidentiality of your account credentials. Alternatively, you may use social login (e.g., via Google) to access the App. Even if you use the App without registration, some features may remain inaccessible.

5. Prohibited Uses

You agree not to use the App or its content for any purpose that is unlawful or prohibited by these Terms. In particular, you shall not:

Engage in illegal activities: Use the App for any activities that violate local, state, national, or international law.
Harass or harm others: Post hate speech, harassment, threats, or discriminatory content based on gender, sexual orientation, religion, ethnicity, race, age, nationality, or disability.
Distribute harmful content: Engage in spamming, phishing, hacking, or the distribution of malicious software.
Mislead or impersonate: Post misinformation, misleading content, or impersonate others.
Infringe privacy: Collect or track other users’ personal data without consent.
Bypass security: Circumvent, disable, or otherwise interfere with security features or reverse-engineer or modify the App.

Violations of these provisions may result in immediate account suspension or termination, at my sole discretion.

6. Community Guidelines

When engaging with the App, you agree to abide by the following community guidelines:

Respectful Communication: Avoid offensive or harmful language.
Privacy Respect: Do not share personal information of others without their explicit consent.
Safety: Do not post content that promotes self-harm, suicide, or any dangerous behaviors. When discussing sensitive topics, please include appropriate trigger warnings.
Prohibited Activities: Avoid spamming, trolling, and posting any illegal, explicit, or NSFW content.

Failure to adhere to these guidelines may lead to warnings, temporary suspension, or permanent banning from the App.

7. Maintenance and Availability

I may, at my discretion, schedule maintenance or experience downtime for technical reasons. I will endeavor to provide reasonable notice when possible, but I do not guarantee uninterrupted or error-free access to the App.

8. Charges, Payment, and Subscription

8.1. Charges and Support Options

The MentalJourney App is free to use. However, if you choose to support the platform and access an ad-free experience, you may subscribe for $10 per month. The revenue from subscriptions is allocated as follows:

Platform Fees: 30% is retained by Apple or Google Play as platform fees.
Revenue Allocation:
- If you select a Church: 70% of the remaining amount is forwarded to your chosen Church, and 30% supports MentalJourney’s operational costs and future upgrades.
- If you do not select a Church: 100% of the remaining 70% is applied to sustaining and improving the App.
MentalJourney absorbs all bank transfer fees for international church support, reducing the actual revenue received.

8.2. Subscription & Cancellation

Subscriptions auto-renew on a monthly basis unless canceled. You may cancel your subscription at any time via your App Store or Google Play settings. Upon cancellation, premium features will remain available until the end of your current billing cycle.

9. Indemnification

‍You agree to defend, indemnify, and hold harmless Aaron Charles Gabriel, his affiliates, officers, agents, and employees from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees and costs) arising out of or in any way connected with:

Your access to or use of the App;
Your violation of these Terms or any applicable law or rights of a third party;
Any content you post or transmit through the App.

This indemnification obligation applies regardless of whether the alleged claim is based on contract, tort, or any other legal theory. Nothing in these Terms shall be construed as imposing any obligation on me to indemnify or hold harmless any other party.

10. Disclaimers, Warranties, and Limitation of Liability

10.1. “As Is” Basis

The App is provided on an “as is” and “as available” basis, with all faults and without warranty of any kind, whether express or implied.

10.2. No Warranty

I make no representations or warranties regarding:

The accuracy, reliability, or completeness of any content;
The App’s uninterrupted, timely, or secure operation;
The absence of errors, viruses, or other harmful components.

10.3. Limitation of Liability

To the fullest extent permitted by applicable law, under no circumstances shall I be liable for any:

Direct, indirect, incidental, special, consequential, or punitive damages,
Loss of profits, revenue, data, or use,
Costs of procurement of substitute goods or services,arising out of or in connection with your access to, use of, or inability to use the App—even if I have been advised of the possibility of such damages.

10.4. Mental Health and Self-Harm Disclaimer

The content provided in the App is not a substitute for professional medical or psychological care. If you are experiencing distress or a mental health emergency, please seek assistance from a licensed professional immediately. I shall not be liable for any harm, injury, or adverse outcome resulting from reliance on the App’s content.

11. Confidential Information & Privacy

Any information submitted through the App is not considered confidential. By providing any content or data via the App, you grant me permission to use, reproduce, and distribute such content in accordance with the Privacy Policy.

12. Force Majeure

I shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond my reasonable control, including but not limited to:

Internet outages;
Cyberattacks;
Natural disasters;
Pandemics;
Government regulations.

In the event of a force majeure, any obligations under these Terms may be suspended for the duration of the event.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Singapore. Any disputes arising from or related to these Terms or your use of the App shall be resolved exclusively in the courts located in Singapore.

14. Miscellaneous

Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision shall be deemed severed and the remainder shall remain in full force and effect.
Entire Agreement: These Terms constitute the entire agreement between you and me regarding your use of the App and supersede all prior agreements and understandings.
No Waiver: Failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
Assignment: I may assign these Terms or any rights or obligations hereunder without notice to you. You may not assign or transfer any rights or obligations under these Terms without my prior written consent.

15. Amendments

I reserve the right to modify these Terms at any time. The most current version of these Terms will be posted on the App, and your continued use of the App after any modifications will constitute your acceptance of the revised Terms.
